These Terms govern Your use of the Service and the agreement between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms, which apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, or by making a Reservation, You agree to be bound by these Terms. If You disagree with any part of these Terms, You may not access or use the Service.

Your use of the Service is also conditioned on Your acceptance of Our Privacy Policy, which describes how We collect, use, and disclose Your personal data, including information shared with Suppliers and the Payment Gateway to fulfil Your Reservation. Please read the Privacy Policy carefully.

Qool Qatar acts as a destination management company and booking intermediary. We curate, market, and facilitate the reservation of Activities that are ultimately organized, operated, and delivered by independent Tour/Activity Operators in Qatar. Unless expressly stated otherwise on the Service, Qool Qatar does not itself own, operate, or control the venues, vehicles, equipment, or personnel used to deliver an Activity.

While We take reasonable care in selecting and presenting Suppliers, the actual performance of an Activity — including safety, conduct, timing, and quality on the day — is the responsibility of the relevant Supplier, who may also be subject to their own terms, waivers, or house rules that You may be required to accept at the point of participation.

You agree to provide current, complete, and accurate information — including traveler names, contact details, and any information required by a Supplier for check-in or entry — when making a Reservation. It is Your responsibility to review the Activity details, date, time, meeting point, inclusions, and any restrictions (such as age, health, or fitness requirements) before completing a booking.

Prices displayed on the Service are as set by Us or the relevant Supplier and may be shown inclusive or exclusive of applicable taxes or fees, as indicated at checkout. We reserve the right to change prices at any time before a Reservation is confirmed and paid for. Once a Reservation is confirmed and paid, the price for that specific Reservation will not change, save for any additional charges you separately request or authorize (for example, add-ons at the activity itself). We reserve the right to correct genuine pricing errors on the Service, even where an order appears to have been placed, and will notify You before completing any Reservation affected by such an error.

All payments for Reservations are processed through Our designated Payment Gateway. By making a Reservation, You authorize the Payment Gateway to charge Your selected payment method for the total amount due, including any applicable taxes and fees shown at checkout.

Qool Qatar does not collect, view, or store Your full card number, CVV, or card expiry date; these are entered directly into the Payment Gateway's secure environment. The Payment Gateway processes payments subject to its own terms and security standards (including PCI-DSS), which you may be asked to review or accept separately during checkout. We are not responsible for the acts, omissions, or technical failures of the Payment Gateway, though We will reasonably assist in resolving payment

discrepancies relating to Your Reservation.

You agree to keep Your payment details and billing information accurate and up to date, and You are responsible for any charges resulting from expired, cancelled, or invalid payment methods provided at checkout.

We reserve the right to refuse, cancel, or place on hold any Reservation that We reasonably believe to be fraudulent, unauthorized, made in breach of these Terms, or affected by a technical or pricing error. Where a Reservation is cancelled for these reasons after payment has been taken, We will arrange a refund via the original Payment Gateway and payment method, save where the funds are subject to a legal hold or investigation by a competent authority.

Each Activity listed on the Service may carry its own cancellation and refund policy, set by the relevant Supplier and displayed to You before You confirm Your Reservation (for example, "free cancellation up to 24 hours before," or "non-refundable"). The specific policy shown at the time of booking will govern that Reservation, and prevails over any general statement in these Terms.

Except where a more favorable Supplier-specific policy applies, or where otherwise required by applicable Qatari consumer protection law, Reservations are non -refundable and non-transferable once confirmed.

If a Supplier cancels, materially reschedules, or is unable to deliver an Activity as booked, We will notify You as soon as reasonably possible and assist You in obtaining, as applicable, an alternative Activity of comparable value, a rescheduled date, or a refund of amounts paid for the affected Reservation, in accordance with the Supplier's policy and applicable law.

Neither We nor the Supplier will be liable, and no refund will be due, where a Supplier refuses entry or participation due to Your failure to meet stated requirements for the Activity (such as age, health, fitness, dress code, required documentation, or safety instructions), or due to unlawful, unsafe, or disruptive conduct on Your part.

No refund will be owed by Us or a Supplier for the cancellation, curtailment, or non-performance of an Activity caused by circumstances beyond reasonable control, including extreme weather, natural disaster, public health emergency, act of government or public authority, strike, or other event of force majeure — except where the applicable Supplier's policy or Qatari law provides otherwise, in which case that more favorable treatment will apply.

When using the Service or participating in a booked Activity, You agree to:

• Provide accurate traveler information and arrive at the specified meeting point on time with any required identification or documents.

• Comply with the reasonable instructions, safety rules, and house policies of the Supplier delivering the Activity.

• Take responsibility for assessing Your own and Your fellow travelers' fitness, health, and suitability to participate in a given Activity, and disclose any relevant condition to the Supplier where requested.

• Not use the Service for any fraudulent, unlawful, or unauthorized purpose, including submitting false payment information or attempting to resell or commercially exploit a Reservation without Our prior written consent. We reserve the right to refuse service, cancel a Reservation, or suspend Your Account where We

reasonably believe these obligations have been breached.

The Service and its content — including text, graphics, logos, images, and software (excluding content owned by Suppliers or licensed from third parties) — are the property of Qool Qatar or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service's content without Our prior written consent, except as necessary to make and manage a personal Reservation.

The Service may contain links to third-party websites or services that are not owned or controlled by the Company, including Supplier websites, the Payment Gateway's checkout pages, or partner tourism resources. The Company has no control over, and assumes no responsibility for, the content, terms, or privacy practices of any such third-party sites or services. We strongly advise You to review the terms and privacy policies of any third-party site or service You visit or use in connection with a Reservation.

We may suspend or terminate Your access to the Service or Account, without prior notice, where We reasonably believe You have breached these Terms, engaged in fraudulent or unlawful conduct, or where required by law. Upon termination, Your right to use the Service will cease, though these Terms will continue to apply to any Reservation already confirmed prior to termination.

To the maximum extent permitted under the laws of the State of Qatar:

• We act as an intermediary facilitating Your Reservation with independent Suppliers, and We are not liable for the acts, omissions, negligence, or performance of any Supplier, or of the Payment Gateway, in delivering an Activity or processing a payment.

• The entire liability of the Company and its suppliers under these Terms, and Your exclusive remedy, shall be limited to the amount You actually paid Us for the specific Reservation giving rise to the claim.

• In no event shall the Company be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or personal injury arising from the use of, or inability to use, the Service, save for liability that cannot lawfully be excluded or limited under Qatari law (such as liability for death or personal injury caused by Our proven negligence, or fraud).

Where applicable mandatory consumer protection provisions of Qatari law grant You rights that cannot be limited or excluded, those provisions will prevail over any conflicting term above.

The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non- infringement, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components, or that any Activity will meet Your specific expectations, though We take reasonable steps to ensure the accuracy of

information displayed on the Service.

These Terms, and any Reservation made through the Service, shall be governed by and construed in accordance with the laws of the State of Qatar, without regard to its conflict of law provisions. If You have a concern or dispute regarding the Service or a Reservation, You agree to first contact Us at support@qoolqatar.com to attempt to resolve the matter informally. If the dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the competent courts of the State of Qatar, without prejudice to any mandatory consumer protection rights You may have under the law of Your place of residence.

You represent that You are not located in, or a resident of, any country or region subject to applicable trade sanctions or embargoes, and that You are not listed on any government list of prohibited or restricted parties, to the extent such representations are required for Us to lawfully process Your Reservation and payment.

If any provision of these Terms is held unenforceable or invalid under applicable law, that provision will be interpreted to achieve its intended purpose to the greatest extent possible, and the remaining provisions will continue in full force and effect.

These Terms may be made available in languages other than English for Your convenience. In the event of any conflict or inconsistency between versions, the English-language text shall prevail.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. Where a change is material, We will make reasonable efforts to provide notice — such as posting an update on the Service or notifying You by email — before the new Terms take effect. Continued use of the Service, or making a new Reservation, after such changes take effect constitutes Your acceptance of the revised Terms. If You do not agree to the revised Terms, You should stop using the Service.
